Service Terms & Conditions

1. Introduction

These Service Terms & Conditions (“Terms”) apply to all lawn, garden, maintenance, and property-care services (“Services”) provided by MockedUp Garden Services (“we”, “us”, “our”). By booking or using our Services, you (“you”, “the client”, “the customer”) agree to these Terms.


2. Service Scope & Limitations

We will carry out the Services as agreed in your booking, quote, or service plan. Any work outside the agreed scope will be charged additionally. We reserve the right to decline any service if conditions are unsafe, unreasonable, or outside our operational capability. All estimates for service timeframes are indicative only and may vary due to weather, access, or site conditions.


3. Access to Property

You are responsible for ensuring safe and reasonable access to the property at the agreed time. Locked gates, aggressive animals, or site obstructions may result in rescheduling fees. If we are unable to access the property upon arrival, a call-out fee may apply.


4. Condition of Property

You must disclose any hazards, uneven ground, hidden objects, or risks that may cause damage or injury. We are not liable for damage caused by hazards that are not visible or not disclosed, including but not limited to rocks, irrigation lines, cables, hidden pipes, pet toys, or reticulation. Excessively long grass, overgrowth, or neglected areas may incur additional charges.


5. Weather Conditions

Services may be rescheduled at our discretion due to unsafe or unsuitable weather conditions. Wet grass, soft soil, or high winds may prevent certain services such as mowing or hedge trimming. We are not responsible for delays caused by weather.


6. Damage & Liability

We take reasonable care while providing our Services; however, we are not liable for pre-existing damage, damage caused by hidden or undisclosed objects, damage resulting from structural weakness, poor installation, or old equipment, or any environmental or pest-related issues. Any claim for damage must be reported within 24 hours and must include supporting evidence. Our total liability shall not exceed the price paid for the specific service in question.


7. Customer Responsibilities

You agree to provide accurate information about the property, ensure that pets and children are safely contained, clear major debris or hazards prior to service, and provide access to water or power where required.


8. Service Quality & Variations

We aim to provide high-quality work; however, final results depend on the existing condition of your property. Variations such as differing grass thickness, weed levels, or overgrowth may affect final results and may require additional work and cost. We do not guarantee outcomes affected by environmental or soil conditions outside our control.


9. Pricing & Payment

All prices are in NZD and include GST where applicable. Payment is required before the commencement of any service, unless a different arrangement has been approved in writing. Bookings are not confirmed until payment has been received. Late or unpaid invoices may result in cancellation of the scheduled service or refusal of future bookings. Quotes are valid for 7 days unless otherwise stated.


10. Health & Safety

We follow New Zealand health and safety protocols. We reserve the right to pause or refuse work if conditions are unsafe. You must ensure our team can perform the work without risk of harm.


11. Waste Removal

Standard lawn mowing includes grass clippings mulched or left on site unless removal is requested. Garden waste removal may incur an additional disposal fee.


12. Cancellations & Rescheduling

Cancellations require a minimum of 24 hours’ notice. Late cancellations may incur a fee. If we arrive on-site and are unable to proceed due to access or safety issues, a call-out fee may apply.


13. Repeat & Scheduled Services

Regular service plans require consistent access and timely payment. Missed services due to customer access issues may still be charged.


14. Right to Refuse Service

We may refuse or discontinue service if conditions are unsafe, if there is abusive or aggressive behaviour, or if the property poses a risk to our equipment or staff. We also reserve the right to decline service where expectations are unreasonable or outside industry-standard results.


15. Changes to Terms

We may update these Terms at any time by publishing the updated version on our website. Continued use of our Services indicates acceptance of the updated Terms.


16. Governing Law

These Terms are governed by the laws of New Zealand. Any disagreement, claim, or dispute arising from our services will be handled exclusively under New Zealand jurisdiction through the appropriate legal channels.
